Terms of service

1. Operator and scope

The service is operated by [NAME], [STRASSE], [PLZ ORT] (“we”). These terms govern every contract for the use of Weighbridge. Conflicting terms proposed by a user do not become part of the contract.

2. What the service does

Weighbridge transfers weight and body composition data from a Withings account you connect into a Garmin Connect account you connect, including propagating deletions.

Weighbridge is an independent service. It has no connection to Garmin Ltd. or Withings SA and is provided neither on their behalf nor with their support.

3. Formation of contract and free trial

Registering forms a contract for a free 30-day trial. During the trial, measurements from the preceding 30 days may be imported.

The trial ends automatically. No cancellation is needed and no charge arises if you do not subscribe. When it ends, syncing stops; data already stored is retained.

4. Paid subscription

The subscription costs EUR 10.00 per year including VAT and renews annually unless cancelled. It can be cancelled at any time with effect from the end of the current period, and remains usable until then.

A subscription allows import of the preceding two years of measurements. Subscribing during the trial applies this immediately.

Payment is contracted with Paddle.com Market Ltd. as merchant of record, whose terms additionally govern payment, invoicing and refunds.

5. Your obligations

You may connect only accounts you own, must keep your credentials confidential, and must not use the service in a way that places an unreasonable load on the connected services.

6. Availability

We aim for continuous availability but do not warrant any particular level of it. Maintenance and faults at the providers we depend on may cause interruptions.

7. Dependence on third parties

Garmin publishes no official interface for third parties to write weight data. Weighbridge therefore uses the same interfaces the Garmin Connect website uses. Garmin may change these at any time and without notice.

If such a change makes the service permanently impossible to provide, either party may terminate for cause. In that case we refund the portion of the fee attributable to the remaining unserved period, pro rata. No further claims arise.

This clause is stated explicitly because it describes a real risk rather than a theoretical one.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For ordinary negligence we are liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance a user may regularly rely — and then limited to the foreseeable damage typical for this kind of contract.

Weighbridge is not a medical device. The values it transfers come from your scale, are estimates produced by its manufacturer, and are not suitable for diagnostic purposes.

9. Backups

Your measurements live at Withings and, once transferred, at Garmin. Weighbridge is not an archive and is not a substitute for a backup.

10. Changes to these terms

Changes are announced by email at least six weeks before they take effect. If you do not object before that date the changes are deemed accepted, and the announcement will say so separately. If you do object, the contract ends on that date and any prepaid fee is refunded pro rata.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.

If any provision is invalid, the remainder stays in force.
